"The fair Act" makes it clear that any advertised apartment posted by a licensed real estate salesperson or broker, implicates they are hired by the landlord and the landlord must pay the broker fee. However, a licensed real estate salesperson or broker can be hired as a tenants agent to help represent them for any non advertised available apartment for rent.
- 04Absolutely they are! Rents are an average of 15% - 30% higher in the current market to compensate getting higher rent and paying the advertising agent. This increase is an added monthly expense and all renewal will be based of the inflated prices.

- 06This is 100% true. Even though the "Fair Act" has passed, landlord do not want to pay. This is the truth. I see first hand apartment availability list emailed to large real estate firms. These Broker blast clearly state "This is for information purposes only, do not advertise, we are not paying the broker fee" So this creates less available option to the public and just inflates the prices on listed apartment. This also created less inventory online.
